Torture Victims Awarded Compensation
Kathmandu 04 Feb 2015: On 3 February 2015, the District Court Khotang gave verdict in the torture cases that were filed separately by 9 torture victims on 17 May 2013. The Single Bench of District Judge Ishwori Prasad Gautam ordered to provide compensation of NPR 75,000/- to Dinesh Rai whose right leg was broken and NPR 50, 000/- to Gandhuram Rai whose right hand was broken due to police torture and take departmental actions against Assistant Sub-Inspector Shyam Poudel, the then in charge of Police Office Halesi and Sub-Inspector Netra Bahadur Shrestha, the then In charge of Police Office, Dhitung, Khotang district.
The incident took place in the morning of 20 April 2013. Dinesh Rai, 40 said, "We were buying a sweat towel (gamchha) from Shree Ram Prints outside the Halesi temple near the gate. We had an argument with the shopkeeper. The police suddenly charged lathi on us. Then I returned to the hotel where I had stayed. After a while there arrived some policemen under the command of ASI Shyam Poudel and reportedly beat me with sticks and kicked me randomly with boots by taking me out from the hotel. I was dragged towards the nearby police station. Once in the police station, I was tortured by beating with sticks. Due to the police torture my right leg was broken."
Another victim Gandhuram Rai, 27, said, "After police started lathi charge I ran away from there and returned to the hotel where I was staying. However, after a while there arrived 3 policemen. While arresting me SI Netra Shrestha hit me with a riffle butt on my right hand and other policemen beat me with sticks on my back and bottom. Once inside the police station they handcuffed me with another detainee Milan, took us to a room, forced us to lie down on the floor face down and then ASI Shyam Poudel stepped on our heads with boots and beat on our bottom, back and legs with sticks for about 5 minutes. Due to the police torture my right hand was broken."
In the incident 7 other victims including minors and women were also ill-treated, verbally abused and tortured by police. They had also filed cases under Torture Compensation Act – 2053, before the District Court, Khotang, However, the Court dismissed their cases based on insufficient documents to prove torture on the plaintiffs.
